These Terms of Service (the “Terms”) govern your access to and use of pelicanstatetech.com and its subpages (the “Site”), operated by Pelican State Tech (“Pelican State Tech,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Pelican State Tech is a technology consultancy based in Columbia, Louisiana. We design and build custom software, web and mobile applications, cloud infrastructure, data platforms, and AI systems, and we provide related technical and organizational consulting.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your own informational and business evaluation purposes. All other uses require our prior written permission.

The Site and its contents, including text, graphics, logos, page layouts, design elements, and code, are owned by Pelican State Tech or our licensors and are protected by United States and international intellectual property laws. The Pelican State Tech name and logo are our marks and may not be used without our prior written permission. Client names, logos, and marks shown on the Site remain the property of their respective owners and are displayed to identify work we have performed.
You may not copy, reproduce, republish, distribute, modify, or create derivative works from the Site or its contents except as expressly permitted in these Terms.
If you submit an inquiry, message, or other information through the Site, you represent that you have the right to provide it and that it is accurate. Please do not send us confidential or proprietary information through the Site. Information submitted through the contact form is not treated as confidential and does not create a confidential relationship, an attorney-client style privilege, or any professional engagement. If you grant us feedback or suggestions about the Site or our services, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.
Nothing on the Site is an offer to perform services, and no engagement is formed by contacting us or by our response. Any services we perform are governed exclusively by a separate written agreement, such as a proposal, statement of work, or master services agreement, signed by both parties. Where that agreement conflicts with these Terms with respect to the services, the signed agreement controls. Descriptions of services, timelines, or outcomes on the Site are illustrative and are not commitments.
The Site links to websites and applications operated by our clients and by other third parties. We do not control those properties, do not endorse their content, and are not responsible for their availability, accuracy, or practices. Your use of any third-party site is at your own risk and subject to that site’s own terms.
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any content on it is accurate, complete, or current.
To the fullest extent permitted by law, Pelican State Tech and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your use of or inability to use the Site, whether based in contract, tort, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Site will not exceed one hundred United States dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Pelican State Tech and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
Our handling of information collected through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Louisiana, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them freely. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site.
